Terms of Service

These Terms govern your use of ActionPanel AI and the hosted services and APIs it relies on (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

About the Service

ActionPanel AI is a WordPress plugin and hosted AI service that helps administrators manage their site — answering questions, generating content, and proposing changes that it can apply to the site once an administrator approves them. The Service uses a combination of proprietary systems, site context provided through the plugin, and third-party large language model providers to generate its responses and proposed actions.

AI limitations

The Service may produce inaccurate, incomplete, outdated, or inappropriate results. Its outputs include generated content — such as drafted posts, pages, product copy, images, and SEO metadata — and proposed changes to your WordPress site, content, and settings. These outputs are generated with the help of AI, are not professional advice, and should not be relied on without your own review.

You are responsible for reviewing all outputs before relying on, publishing, or applying them. When you approve a proposed change, ActionPanel applies it to your site, which may modify your content, configuration, or live site. The plugin is designed so that proposed write operations require explicit administrator approval before they are applied, but you remain responsible for the changes you approve.

Plugin license

The ActionPanel AI WordPress plugin is licensed under the GNU General Public License, version 2 or later. Nothing in these Terms limits your rights under that open-source license with respect to the plugin code. These Terms govern access to and use of the hosted Service, including the API, accounts, generated responses, and related hosted functionality.

Who may use the Service

You must be at least 18 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, abusive, or privacy-violating purposes.
  • Send malicious code, spam, or content that infringes others’ rights.
  • Attempt to disrupt, reverse engineer, overload, scrape, or gain unauthorized access to the Service.
  • Use automated access methods except through official interfaces, APIs, or authorized plugin functionality.
  • Submit sensitive personal data, regulated data, credentials, secrets, or confidential information unless you have the right to do so and accept the associated risks.
  • Use the Service to generate or distribute infringing, deceptive, hateful, or unlawful content.

Accounts and access

Some features may require an account or authentication token. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. We may suspend or terminate access if we believe these Terms have been violated, if continued access creates risk, or if required by law.

Data and privacy

The Service may collect and process prompts, chat messages, usage metadata, account information, technical information, and selected WordPress site diagnostics and configuration data. Depending on plugin settings and administrator actions, ActionPanel AI may send site context, plugin and theme information, selected WordPress settings, the results of approved same-site diagnostic HTTP requests, debug log excerpts when log reads are enabled, account metadata, and allowlisted file metadata or contents needed for troubleshooting.

Third-party AI providers

The Service may send prompts, context, and related data to third-party AI infrastructure providers to generate responses and operate the Service. These providers process data under their own terms and privacy commitments. We do not sell or rent personal data.

Security

We use reasonable technical and organizational safeguards, including encrypted transmission where appropriate. No online service can guarantee absolute security.

Service availability

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or that any response will be accurate or suitable for a particular purpose.

Disclaimers

To the fullest extent permitted by law, Atiba disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Limitation of liability

To the fullest extent permitted by law, Atiba and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or site damage arising from use of the Service.

To the fullest extent permitted by law, our total liability for claims related to the Service will not exceed the amount you paid us for the Service during the 12 months before the claim, or $100 if you paid nothing.

Changes to the Terms

We may update these Terms from time to time. If changes are material, we will provide notice through our website, the Service, or another reasonable method. Continued use after changes become effective means you accept the updated Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your access to it at our discretion, including if you violate these Terms or create risk for us, users, or third parties.

Governing law and dispute resolution

If you ever have a dispute with us, we will first try to resolve it informally. If that does not work, any disputes will be handled through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Nashville, Tennessee. The governing law for this agreement is the State of Tennessee.
